Parents of Tenn. girl injured in Rhino rollover sue Yamaha

Greg and Theresa Mitchell of Clarksville, Tennessee have filed a personal injury lawsuit against Motor Corporation for injuries that their 11-year-old daughter sustained when the Yamaha Rhino she was riding in rolled over.

The Mitchells’ daughter was a passenger in the when it rolled over onto the passenger side. The June 2005 accident occurred while the was being driven soundly, leading the Mitchells to allege that the is dangerously unstable and defective. Like many people throughout the country, the Mitchells suggest the accident would not have occurred if had set higher standards for safety.

While stands by the safety of its , critics claim that the is exceptionally dangerous because of its high center of gravity, narrow track width, narrow wheels and tires, and side-by-side seating.

The Mitchells’ daughter suffered severe injuries to her knee, arm, foot, and ankle in the rollover. She required emergency surgery and surgeons ultimately had to amputate four of the toes on her right foot.

“No more children or adults should suffer serious injuries for simply riding in the ,” said Teresa Mitchell in report from the Wall Street Journal’s MarketWatch.

“In a split second, these dangerous vehicles can change a life forever,” she said.

The Mitchells believe that their lawsuit against will help prompt “to acknowledge its legal responsibility to injured riders and make the a safe vehicle.”

    i have had a 2007 rhino 660 and have a 700 know and i have driven them both on flat ground at slow, medium, and fast speeds going straight and turning and have never rolled them or gotten them on two wheels. i have many years of experience on atvs and side x sides. i think the rhino is very safe [ seat belts, hand holds, doors etc.] there is no way it will turn over going slow in a turn on flat ground. i have seen videos on the internet on you tube that shows how people get injured. its by acting careless then they want to sue the manufactures when it was there fault. look at the reason three wheelers were outlawed from manufacture because parents purchased there 10, 11, 12, and 13 year old kids racing three wheelers designed for 16 year and older experienced riders. when i used to crash my three wheelers and 4wheelers i did not sue the manufactures because it was my fault. if i were to roll my rhino over it would be because i was driving reckless. its not the rhinos fault it cannot drive itself. so stop all the lawsuits and take responsibility for your own actions.
